TheAgent operates TheAgent, an AI assistant service delivered over SMS and messaging apps. You reach the assistant by texting +1 (650) 643-4048. This policy describes what we collect when you use the service and how we handle it. TheAgent is the operator of the service and the entity responsible for your data.

2. What we collect

• Your phone number or messaging-app ID.
• The content of the messages you send to the assistant.
• Assistant memory derived from your conversations — preferences, facts, and context you've shared so the assistant can be useful over time.
• Basic delivery metadata, such as message timestamps and delivery status.

Message content is processed by third-party AI model providers to generate responses.

3. How we use it

We use this information to provide and improve the service, to maintain your assistant's memory so it stays useful to you, and to comply with law. We do not use your information for advertising.

4. Mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding vendors and service providers acting on our behalf solely to deliver the service.

5. Messaging disclosures

Message frequency varies based on your usage. Message and data rates may apply. You can opt out at any time by replying STOP, or get help by replying HELP or emailing theagentsupport@gmail.com.

6. Sharing

We share information only with service providers that help us run the service — messaging delivery, cloud hosting, and AI model providers — and when legally compelled to do so. We do not sell personal information.

7. Retention & deletion

We retain your information while your account is active. Email theagentsupport@gmail.com to request deletion of your data, including assistant memory.

8. Your rights

You may request access to, deletion of, or correction of your personal information at any time by emailing theagentsupport@gmail.com. If you are a California resident, you have these rights under the California Consumer Privacy Act (CCPA), and we honor them for all users.

9. Children

The service is not directed to children under 13, and we do not knowingly collect information from them. If you are under 18, you may use the service only with a parent's or guardian's consent.
